The “Artesanía y Decoración Casals, S.L.” website is exclusively intended for adults and contracts with minors are not permitted. We expressly request that parents or legal guardians take appropriate measures to prevent minors from registering and making purchases. Registration implies, on the part of the Client, full and unreserved acceptance of the conditions set forth. Visiting this site or purchasing from it grants you the status of user and implies full and unreserved acceptance on your part of the General Terms and Conditions (hereinafter “GTC”) in the latest version published on www.articulosreligiosos.com (hereinafter “the Website”). As a user, you express your willingness to respect and accept the conditions established by Artesanía y Decoración Casals, S.L. for access to and use of the Website. These GTC may be archived and/or printed by the user, who is under no circumstances authorized to alter their content or to act outside of it.

It is strictly prohibited to modify, transmit, distribute, reuse, resend, or use all or part of the content of the page for public or commercial purposes including text, images, audio and/or video without the written authorization of Artesanía y Decoración Casals, S.L. It is strictly prohibited to download images of the products for sale on this page.

Artesanía y Decoración Casals, S.L. may modify these conditions of access and use at any time. These revisions are binding, so you should periodically visit this section to check the conditions of access and use in force at any given time, which will be those posted on the network at the time you access the Web.

The Client hereby authorizes the incorporation of his/her data into a mixed file owned by “Artesanía y Decoración Casals, S.L.” for processing within the framework of the company’s daily management, its legal and commercial relations, including the sending of commercial communications and advertising to its clients. The Client is also informed that he/she has the right to access, rectification, opposition and cancellation under current legislation on the protection of personal data (L.O. 15/99). Internet sales system

To find an article you can use the navigation menus located at the top of the page under the header with the logo. Through them you can access the different classifications and groupings of products. You can also use the search engine located at the top, the search result will display the items available depending on the data entered.

Once the family or subfamily of articles has been selected, another menu with various selection criteria appears on the left of the page. Once you have found the item, you can expand the information by clicking on its name, its image or purchase it directly. This will take you to the product sheet, which contains detailed characteristics of the product, other related products, applied promotions, and accessories.

To see the different decorations or finishes of each of the products, you must click on the decoration/finish to see its details.

For some items that are made in different sizes, you must select the size and the prices will be displayed (VAT included). IMPORTANT: HEIGHT, DECORATION AND MATERIAL must be selected in order to display the exact price.

How to order

It’s very simple. Simply add the product to your basket by entering the number of items you want and clicking on the ‘Add to cart’ icon.

Once in the basket, you can continue purchasing other items or process the order with the products included by clicking the button located at the bottom right ‘Place Order’.

If a product does not display the price, if you require further information, we will be happy to provide you with all the necessary information if you contact us by phone or email.

When you place an order, all transactions from that moment on are carried out under a secure connection that guarantees the confidentiality of all your data.

A screen will ask you for your username and password. If you are already a registered customer, you will only need to enter this information.

If you are not yet a member and wish to register, you can do so from the registration link located at the top of the page, and thus obtain a user name and password that you will use for subsequent transactions you make on our website. You can purchase products, receive information about offers and promotions, find out the status of your orders, etc. Your personal details will be recorded in your customer file, so you will not need to fill them in again for subsequent purchases.

You can also make a purchase without registering. In this case, you must fill out a form with your address details and payment method, which will only be used to process the current order.

You must then select the payment method you wish to use:

– Bank card (credit or debit).
– Bizum
– Paypal.
– Bank transfer.

Finally, a page will confirm the successful processing of the order, and will display the order number, as well as a summary of the products purchased. The purchasing process has ended.

Once you have placed your order, you will receive an email at your email address confirming receipt of your order and acceptance of the General Conditions.

Purchases made on the Web will be subject to current regulations and other relevant legislation, with sales transactions being deemed to have been made at the address of Artesanía y Decoración Casals, C/ Boters, 7 and 9. 08002 Barcelona.

Taxes

European Union Residents

The prices of the products are for sale in our e-commerce stores include Value Added Tax (VAT), as provided in current regulations for natural or legal personsresident in Member States of the European Union. Orders will not be PO boxes.

Purchases made by the taxable persons (companies, institutions, organizations …) residing in the European Union and provided with intra Tax shall be exempt from paying VAT, being an essential condition to send the document by e-mail at info@articulosreligiosos.com

Residents of EU countries

Purchases made by individuals or legal entities resident in countries outside the EUare exempt from VAT. Orders will not be PO Boxes.

For this system of purchase / delivery and because of its tax system, are considered non geographical areas the Canary Islands, Ceuta and Melilla.

Please note that the prices quoted for shipping costs do not include taxes (tariffs) on imports or other fees that may be applicable in the destination country, to be paid on arrival by the receiver of the goods.

Since each country has a different tax policy, we at www.articulosreligiosos.com are unaware of the amount of taxes at destination. Please contact your country’s monetary authorities to find out the amount in advance.

Failure to pay taxes and customs fees at the destination in a timely manner may result in the package being returned to origin or destroyed. In this case, ‘Artesanía y Decoración Casals, S.L.’ is exempt from the obligation to refund all or part of the amount of the order.

The purchasing system is subject to current legislation in Spain.

Payment methods

You can pay for your order in 4 different ways (see below for availability depending on destination):

** Credit card: we charge the amount of the order at the time of purchase. Your financial institution will charge you the amount in accordance with the terms and conditions previously agreed upon with it.
** Bizum: we charge you the amount of the order at the time of formalizing the purchase. Payment system valid for Spain.

All prices include VAT and you can select payment in the currency of your choice, but settlement will be made based on the Euro currency. Prices in currencies other than the Euro may vary from one day to the next, always calculating the price at the time of purchase in your order.

Shipping costs must be added to the order amount, where applicable (see methods and prices in the shipping costs and conditions section).

The recipient will be responsible for any customs charges or other fees applicable in each destination country (if any).

For payments made by card outside of Spain, your bank will charge the amount of the order in your currency at the exchange rate in effect at that time.

Shipping costs and conditions

Shipping costs:

Mainland Spain, Balearic Islands and Mainland Portugal: Shipping costs are borne by Artesanía y Decoración Casals SL if the order amount is greater than 100 euros. Otherwise, the shipping costs will be those corresponding to the selected item, which appear when calculating the order amount.

France, Italy and Germany: Shipping costs are borne by Artesanía y Decoración Casals SL if the order value exceeds 250 euros. Otherwise, the shipping costs will be those corresponding to the selected item, which appear when calculating the order amount.

Canary Islands, Ceuta and Melilla: Shipping costs are borne by Artesanía y Decoración Casals SL if the order value exceeds 250 euros. Otherwise, the shipping costs will be those corresponding to the selected item, which appear when calculating the order amount.

Rest of the World: Shipping costs will be those corresponding to the selected item, which appear when calculating the order amount. Depending on the items selected, we would appreciate it if you would contact us to provide you with the most advantageous conditions possible.

Delivery Time:

They will vary depending on the destination of the shipment and the method of transport, whether land, air or sea. As a general rule, the estimated deadlines would be:

Mainland Spain and the Balearic Islands: 24/72 hours (working days) when the selected item is in stock at our facilities, not including handling and shipping preparation time. Deliveries are not made on Saturdays, Sundays or holidays.

If any of the selected items are not available in stock, we will contact you as soon as possible to inform you of the approximate delivery date.

France, United Kingdom, Italy, mainland Portugal and Germany: 3/5 working days when the selected item is in stock at our facilities, not including handling and shipping preparation time. Deliveries are not made on Saturdays, Sundays or holidays.

Order delivery:

Orders will be delivered to the address designated by the customer, therefore, Artesanía y Decoración Casals S.L. assumes no responsibility when delivery cannot be made as a result of the data provided being incorrect, inaccurate or incomplete. If the delivery address is incorrect or the recipient subsequently modifies it, the corresponding reshipment costs will be borne by the customer. In the event that the order is rejected by the recipient or the recipient is absent, Artesanía y Decoración Casals SL assumes no responsibility and reserves the right to charge the customer 100% of the value of the order.

Delivery to hospitals and/or public buildings:

Deliveries to hospitals, hotels, public bodies and other places where there are restrictions on access to the general public will be delivered to the reception or a similar place, provided that it is not possible to deliver the goods by hand to the recipient. In this case, an attempt will be made to collect the signature of the receptionist or similar, and the order will be considered as delivered, without assuming any responsibility derived from the moment after delivery. In order to achieve a more effective delivery of your order, we need you to make sure you provide us with as much information as possible such as apartment name, room number, floor number, full name of the recipient.

Is it safe to pay by card?

When purchasing online with a credit card on our website, both validation and actual payment are carried out using the same system as in a conventional store with maximum security.

All information associated with the payment is entered on the bank’s website, leaving Artesanía y Decoración Casals SL unaware of any information related to the payment. Once the transaction is completed, our bank will send us a communication with the approval/denial of the operation.

To ensure confidentiality when transferring data over the Internet, a security protocol, SSL (Secure Sockets Layer), is used, which is accepted by the vast majority of browsers. This system ensures the identity of the seller, guarantees the integrity of the message and encrypts the data with up to 128-bit encryption (it would take thousands of years for the most powerful computer in the world to decode the message).

Our bank has implemented ‘Secure Electronic Commerce’, which adds an additional element of security through a code associated with the card that only its owner knows. Thus, after entering the card number when purchasing online, the merchant will ask the customer for their personal code that identifies them as a legitimate user of the card (provided that the buyer’s bank has implemented this system).

Availability of items

We have classified the items in our catalogue into two groups according to their availability:

** Availability: In Stock: the product is in our warehouse.
** “On request” availability: the product is not in stock. A manufacturing order must be given to the workshop, and it can be delivered within a period that can range from 3 to 37 days depending on the item selected. Please check availability to speed up the purchasing process as much as possible.
If your order contains items that are not available, Artesanía y Decoración Casals, S.L. will wait until it has all the items you have purchased and will send them to you in a single shipment, although this circumstance will always be agreed upon with the buyer.

In the case of requesting manufacturing orders for items worth more than 250 euros, Artesanía y Decoración Casals, S.L. will request a 30% deposit from the buyer on the total amount. If the customer, once the work has been completed and ready for shipment, cancels the order, he/she will lose the amount paid on account.

Items ordered under express manufacturing order, or personalized, are excluded from the right of withdrawal or return thereof.

Billing

Likewise, pursuant to the provisions of article 17 of the Regulation governing billing obligations, approved by Royal Decree 1,496/2003, of November 28, “Artesanía y Decoración Casals, S.L.”, with CIF: B-61528568, and registered office at C/ Boters, No. 7-9, Principal 1ª, 08002 Barcelona, may send invoices and other documents using electronic means.

As stated in the aforementioned Royal Decree, documents sent electronically have the same legal validity as printed documents, provided that they are kept in the format in which they were generated (electronically).

The Client expresses his/her consent to the use of the PDF format that will be used by “Artesanía y Decoración Casals, S.L.”, stating that he/she has the necessary computer means for this purpose. Likewise, the email address provided at the time of registration is established as mandatory information for receiving invoices.

By accepting the conditions, the parties exclude the sending of the same in paper format, except for an express request that must be addressed to “Artesanía y Decoración Casals, S.L.”.

Code and password

Acceptance of these General Conditions implies that the Client will be responsible for managing his/her access account and password with which he/she is granted access to the “Artesanía y Decoración Casals, S.L.” website www.articulosreligiosos.com.

These Conditions apply in addition to the Electronic Commerce conditions.

The Client will be responsible for maintaining the confidentiality of his/her User code and password for his/her account to access the content of the Web www.articulosreligiosos.com, and will also be solely responsible for all activities that occur with his/her User or Account. The Client agrees to immediately notify any unauthorized use of his/her account or any other breach of security. “Artesanía y Decoración Casals, S.L.” will not be liable for any loss or damage resulting from the loss of the account or its use without the authorization of the account holder.

Any person acting using the access codes of a Client of “Artesanía y Decoración Casals, S.L.”, whether a collaborator, manager, etc., will be considered a representative of the Client and with sufficient powers to act as such and bind him/her.

Specific conditions

Likewise, “Artesanía y Decoración Casals, S.L.” reserves the right to cancel both the operations and the Client’s account at any time.

The Client undertakes to use the information received confidentially and for strictly personal purposes and to refrain from distributing or reproducing, in whole or in part, and in any form, said information.

“Artesanía y Decoración Casals, S.L.” reserves the right to modify its price list and offers without prior notice, and orders will be accepted subject to a possible change in price if typographical or other errors are detected.

The price, unless otherwise stated, does not include transport, handling, taxes and other fees or additional charges. These costs will be borne by the Client.

Notwithstanding the foregoing, the invoice issued by “Artesanía y Decoración Casals, S.L.” will be based on the rate in force at the time of supply, regardless of the price indicated above.

The expected delivery times for the material are merely informative and are not binding on “Artesanía y Decoración Casals, S.L.”. Unless otherwise expressly agreed in writing with “Artesanía y Decoración Casals, S.L.”, the Client shall not be entitled to request the cancellation of an order or any compensation, including the return of shipping costs, in the event of a delay in the delivery of the product due to circumstances beyond the control of “Artesanía y Decoración Casals, S.L.”. The Client may not refuse to pay the price of products already delivered when “Artesanía y Decoración Casals, S.L.” makes a partial supply of an order.

Transport

The contracting of any service or product implies consent for your personal data to be provided to the transport company with which “Artesanía y Decoración Casals, S.L.” deals at any given time.

The risk of loss and/or damage during the transport of the contracted merchandise transfers the responsibility to the Transport company.

It is an essential condition that at the time of receipt of the merchandise, any incident that may occur regarding the condition of the merchandise, the packaging, number of packages or any other information that could indicate anomalies in the shipment is indicated on the delivery note that is signed by the carrier. It is essential that you notify “Artesanía y Decoración Casals, S.L.” by fax or email of any incident within a maximum period of 24 hours from receipt of the material, so that we can act if necessary.

Right of withdrawal

The Customer, from receipt of the Product, will have a period of 14 calendar days to exercise his/her right to withdraw or revoke his/her order against “Artesanía y Decoración Casals, S.L.”, in accordance with the distance selling regulations governed by Royal Legislative Decree 1/2007, amended by Law 3/2014, in force since 29 March 2014. After this period, the products will be considered compliant and accepted by the Customer without any right to make a claim. The right must be exercised in a duly certified manner against “Artesanía y Decoración Casals, S.L.”, preferably by email. The following data must be included in the exercise:

1. Purchase invoice number
2. Name and surname of the client
3. Product reference number
4. Number of units for which return is requested
5. Statement of reasons for the return

Upon receipt of this information, “Artesanía y Decoración Casals, S.L.” reserves the right to authorize or not the requested return (RMA) depending on the condition of the product and, where applicable, its warranty. The return of the Product will only be accepted if the following circumstances occur:

a) That the Customer returns the Product unsealed and in the same condition in which it was delivered, that is, in its original packaging and without the Customer’s inscription.

b) That the return number (RMA), obtained from the Customer Service department, appears clearly on the shipping label (never on the packaging).

If upon receiving a product it is found that it does not meet the RMA requirements, it will be returned to the Customer at the Customer’s expense. The Client, from the moment of acceptance of the Product, will have a period of 14 days to send to “Artesanía y Decoración Casals, S.L.”, by email or certified mail, any claim concerning the invoices.

In any case, if the user exercises his right of withdrawal, he will assume the costs of transport and return of the product that may be generated and, where appropriate, compensate for any damage to the object of purchase, all without consideration of penalty and with the exception of the value of the product, which would be reimbursed as soon as possible.

Items ordered under express manufacturing order, or personalized, are excluded from the right of withdrawal or return thereof.

Warranty

Due to its status as an intermediary, the warranty covering the Product delivered to the Client is limited to that extended by the manufacturer. This warranty only covers physical imperfections of the material support. The intervention of “Artesanía y Decoración Casals, S.L.” is limited solely to the processing of the simple exchange of defective parts, provided that the manufacturer’s warranty provides for such a measure.

The warranty applies as long as the Product delivered to the Customer is used under normal conditions, such as those that may be described in the catalogues, instructions or manuals made available to the user. In no case is it guaranteed that the product supplied is suitable to respond to a particular problem of the user.

Responsibilities

“Artesanía y Decoración Casals, S.L.” is not obliged to compensate the user or third parties for the consequences of the use of the product, whether direct or indirect damage, accidents suffered by people, damage to property other than the product, loss of profit or loss of earnings, damages arising from or resulting from deterioration, or loss of data recorded by the user. Return shipping costs for defective products within the warranty period are the responsibility of the Customer, as the manufacturer does not include the cost of shipping costs for the material within the warranty.

If the Client proves the existence of a breach or defective performance of the Contract attributable to “Artesanía y Decoración Casals, S.L.”, it is expressly agreed that its liability will be limited to the return of the amount paid by the Client and to the acceptance of the return of the product caused by the breach, with the parties establishing the optional possibility that “Artesanía y Decoración Casals, S.L.” may send the contracted product in a second shipment and, in the event of impossibility, the sales contract will be deemed to be terminated.

In the event of termination and/or withdrawal from the contract due to the fault of the Client, the latter shall be obliged to compensate “Artesanía y Decoración Casals, S.L.” for any damages caused. Compensation is set at a minimum of 30% of the total sale price, without prejudice to claiming higher compensation if the damage suffered is greater than said 30%.

The period granted for payment will be automatically deemed to have expired for Products already delivered and “Artesanía y Decoración Casals, S.L.” will not be obliged to deliver Products pending delivery when any of the following circumstances occur:

1. A request from the Client for a deferral of payment
2. If the Client is found to be insolvent
3. If there is any overdue invoice unpaid by the Client

If one of these situations occurs, “Artesanía y Decoración Casals, S.L.” may immediately demand payment of the amount owed and terminate the transactions in progress, by simply notifying the Client in writing, without the Client having any right to any compensation.

Until the Customer has fully paid the price and all amounts due as a result of the sale, the Product will be considered property of “Artesanía y Decoración Casals, S.L.”, with all inherent rights. The Client will be considered the custodian of the Products and must store them separately, clearly identifying them.

If prior to full payment for the Products, the client’s assets are subject to any embargo or encumbrance, the embargo notice will expressly state that these are the property of “Artesanía y Decoración Casals, S.L.”. If, despite this, they are seized, it will facilitate the exercise by “Artesanía y Decoración Casals, S.L.” of the relevant third party ownership claim, the costs of which will be borne by the Client.

Legislation and Jurisdiction

The law applicable to these general conditions of sale, as well as to any dispute relating to this contract, will be Spanish law. Any dispute arising from this contract shall be subject exclusively to the jurisdiction of the Courts of Barcelona, Spain.

The contracting parties are exempt from the obligations set forth in Article 27 of the Electronic Commerce Law on information with the exception of mandatory provisions. For this purpose, Artesanía y Decoración Casals, S.L. will send an acknowledgement of receipt or confirmation of the contracted operation.

These include the content of the Electronic Commerce Law, the Retail Trade Law and the Royal Decree on telephone and electronic contracting, among other related provisions.

Notifications

All notifications, requests, demands and other communications to be made in relation to these GTC must be made in writing to: Artesanía y Decoración Casals, S.L., C/Boters, 7 y 9. 08002 Barcelona.

Nullity and ineffectiveness of clauses

If any clause included in these GTC were declared totally or partially null or ineffective, this nullity or ineffectiveness will only affect said provision or the part thereof that is so declared, the GTC remaining in force in all other respects and such provision being considered not to be included.
